It is the process uses to attest to the legality and authenticity of documents to be accepted in countries outside of South Africa and is commonly known as the Legalisation process. In South Africa the Department of International Relations and Co-Operations are the administrators of this process. DIRCO has a Data base of all the authorised signatories of official documents in South Africa. The Type of document and the target country dictates the legalisation process. Authentication is when countries are not signatories to The La Hague Convention documents cannot be Apostilled but must be Authenticated and subsequently be certified by their local Embassy. The normal process as for Apostille will be followed but a Authentication certificate will be issued instead of a Apostille. The documents look the same and are affixed to the document to be Authenticated in the same way. Authentication is used for countries whom are not signatories to the La Hague convention while the Authentication process is used for Non signatories to the La Hague Convention. Such countries include Angola, Kuwait, Libya, Oman, Phillippines, Qatar, Saudi Arabia, UAE and many more. Sometimes the only way to get a document Apsotilled or Authenticated is by making a notary copy of such a document. The notary copy is then presented to the High Court. Apostille for Countries whom is a signatory to the La Hague Convention. • The Apostille will be done by the relevant High Court and no further action is usually needed. Authentication for Countries whom is not a signatory to the La Hague Convention. • Authentication will be done by the relevant High Court. • After the High Court the document must be presented to the Department of International Relations and Co-operation. • The last step will be for the documents to be presented to relevant embassy for final authentication.
